SC judgment on 5th amendment to be accepted: Moudud

BNP stalwart Barrister Moudud Ahmed has denied the Supreme Court Bar Association (SCBA) allegation accusing him of smear campaign against the Appellate Division order upholding the High Court verdict that had scrapped the Constitution 5th amendment.

Fifth Amendment: SC order on 2 writs today

The Supreme Court will pass its order on the two writ petitions challenging the High Court verdict that declared the Fifth Amendment to the Constitution illegal. The six-member full bench led by Chief Justice Tafazzul Islam set the date after concluding the hearing on leave to appeal petitions yesterday. The Supreme Court has set Tuesday for an order on two petitions against the repeal of the Fifth Amendment. A full six-member bench, led by chief justice Tafazzul Islam, set the date on Monday after six days of hearings on the petitions that began on Jan 19. BNP secretary general Delwar Hossain and three pro-Jamaat-e-Islami Supreme Court lawyers—Munshi Ahsan Kabir, Tajul Islam and Kamruzzaman Bhuiyan—filed the two petitions seeking a stay on the 2005 High Court judgment that declared the Fifth Amendment illegal.

JS, not court, can revoke 5th amendment, says Moudud

Barrister Moudud Ahmed, counsel for BNP secretary general Khandker Delwar Hossain, in his submission before the Supreme Court, said yesterday that those 'unnecessary portions' in the fifth amendment to the Constitution, if there was any, could be cancelled by the apex court but the necessary portions should remain valid for the greater interest of the country.

SC for measures to stop martial law

The Supreme Court (SC) on Tuesday observed that there should be measures so that the rule of martial law could not be imposed in the country in future. The apex court made the observation during the third day's hearing on the leave-to-appeal petitions challenging the High Court (HC) verdict that declared the fifth amendment to the country's constitution illegal and void.

Freedom Party fails to meet constitution deadline

Thirty-eight political parties have submitted their fully ratified constitutions to the Election Commission up to the Sunday (Jan 24) deadline. Election commissioner M Sakhawat Hossain, talking to reporters at the EC secretariat, said only the Freedom Party, of 39 parties registered with draft constitutions before the December 2008 general elections, had failed to place its final constitution by the deadline, risking cancellation of registration.

Govt urged not to scrap 5th amendment

Leaders of different political parties yesterday demanded of the government not to revoke the Fifth Amendment of the Constitution. They said that people of the country would resist such movement, as according to them, it would bring the nation back to one-party BAKSAL rule that was introduced in 1975.
